General Conditions of Use of the App, MeetingDoctors Middle East

MeetingDoctors Middle East DMCC (hereinafter, MeetingDoctors) is a computer application (hereinafter, App) designed for mobile smart phones that offers a healthcare chat and video call service to resolve health inquiries and provide peace of mind to its users.

Below, we detail the general Terms and Conditions of Use (hereinafter, Conditions) regulating the access and use of the services and contents by the users provided by MeetingDoctors through its App. MeetingDoctors will inform their users of any update, extension, or modification that may occur in our services, and, in addition, we will make it public on this page.

Subject and Acceptance

These Conditions are intended to regulate the access and use of this App, called MeetingDoctors Middle East.

A User will be understood as any person who accesses, browses, uses, or participates in the services of the App in accordance with the provisions set forth below. MeetingDoctors makes its services offered through said App available to the clients of MeetingDoctors Middle East through the contract or service that the User has with MeetingDoctors Middle East and in which the APP service is included.

To access and use the service offered by MeetingDoctors, the User must have an internet connection and the necessary device for it (a smart mobile phone, tablet, with either Android or iOS operating system or a computer with internet access).

MeetingDoctors recommends using a secure connection and avoiding open networks or public Wi-Fi. In addition, the devices must be compatible with the applications and connections from MeetingDoctors.

Applicable Legislation

These Conditions and all the relationships established between the User and MeetingDoctors are presented in English. The Conditions and, where appropriate, the Individual Conditions will be governed by the applicable laws.

Description of the Services

Through this App, the User can contact healthcare specialists via chat and video calls, allowing the exchange of text messages, images, videos, and any other type of file.

Users can enter and save their primary health data within their profile medical record, which will include sections on allergies, medical conditions, and medication. This data will be automatically shared with the healthcare professionals at the service of the App that the User consults so that they can know the User's health profile and that they, in turn, can modify them to correct, complete, and update the user information.

The App allows its users to obtain Telehealth and Telemedicine services based on the information provided by the User. There will not be, in any case, a performance of any acute treatment or emergency medical care service. Therefore, the services provided by the healthcare specialists through the App may not be suitable to the User's actual state of health if there is a lack of information provided by the User, deficient examination, deficient verification, or as a result of a misinterpretation of communications between the professionals and the User.

MeetingDoctors Middle East does not connect with professionals or third-party medical centres to expand, complete, or corroborate the information provided by its users. The User is solely responsible for the information they enter, which must be truthful and authentic, and for correctly interpreting the information communicated by healthcare specialists through the App.

Likewise, the User undertakes to respect the applicable laws and the rights of third parties when using the contents and services of the App.

This service is in no way meant to substitute an exploration or face-to-face consultation with professionals and/or medical facilities. Therefore if the User is ill and/or requires further exploration and analysis, they should visit a doctor or medical centre immediately.

If the User believes they have a medical emergency, they should call 999 immediately.

Onboarding and offboarding process

Only people with full capacity are bound by the Conditions and contract the services offered may use the service.

User registration and access codes:

To use the services, the User must first provide, at the time of registration, all personal information necessary for conducting a medical consultation service as requested in the App/Widget.

The personal information requested by MeetingDoctors will be limited to information that is necessary for providing the healthcare chat/ video call service efficiently and effectively. Personal information entered must be true, accurate, correct, and up-to-date. The User is solely responsible for non-compliance with this obligation and for any possible damages that could be caused to MeetingDoctors or any third party as a result of any inaccurate personal information provided by the User.

MeetingDoctors will give the user access to the App/Widget by providing a password via email or SMS sent to the email address or mobile number that the User has provided to MeetingDoctors in their registry, which will create a linked service to the User's email address or phone number.

The User undertakes to ensure the confidentiality of their access codes, MeetingDoctors being excluded from any liability that may arise from the User's incorrect or negligent use of passwords.

The User can close the account anytime through the App/Widget by sending an email to support@meetingdoctors.com. MeetingDoctors may terminate the service at any time at its sole discretion. MeetingDoctors also reserves the right to deny registration and close the User's account without prior notice for any reason and at any time.

Communication with healthcare specialists

The User may request support from any of the Healthcare Professionals listed in the App/Widget whose status is marked as available. Those who appear with the symbol on the left in green will be understood as available, and those who are not available are in red. If an unavailable professional is contacted, they will respond within their scheduled hours of availability.

Selecting a particular medical professional will not imply, in any case, the existence of an exclusive relationship between the User and that professional. The service is provided collectively rather than individually, even though the User has initiated a consultation with a specific Healthcare Professional. MeetingDoctors Professionals reserve the right to choose to continue or discontinue any consultation or follow-up

MeetingDoctors makes all the relevant and necessary information about the Healthcare Professionals' profiles available to the User, including their: name, specialization, and experience.

After consulting the Healthcare Professional through the chat or video call, whether self-initiated or as a follow-up, the Healthcare Professional will respond as soon as possible based on their availability.

Through the application, the User and the Healthcare Professional may transfer documentation, images, or any other type of file to better understand the issues being discussed. The User and the Healthcare Professional will solely be responsible for the content they incorporate and the statements they make through the App.

MeetingDoctors reserves the right to withdraw or modify, without prior notice, any content that violates any of the terms and/or conditions.

Nature and scope of services

Healthcare Professionals may recommend over-the-counter (OTC) medication that does not require a prescription, wherein the healthcare professionals' opinion, acting independently, is suitable for use by a particular user. Prescription medication may also be provided if, in the professional's opinion, that would be necessary and the professional has the licenses and privileges to prescribe the medication.

In case of poor health or a medical emergency, the User must contact 999, as the services obtained through the App/widget are not emergency medical services, nor are they a substitute for them.

MeetingDoctors does not guarantee that the information or content provided is current or accurate due to the constant research progress and evolution in the medical field. Without prejudice to the fact that MeetingDoctors will do their best to offer the service, the User acknowledges that text-based advice may not be an appropriate substitute for a physical consultation in some circumstances.

The User may not use any content or information accessed or obtained through the App/Widget for illegal purposes, or for purposes that could cause harm to MeetingDoctors, other users, or the Healthcare Professionals, or for any purposes expressly prohibited by these conditions.

Responsibility for the operation of the App/widget and conditions of use.

To the extent permitted by law, MeetingDoctors will not be liable for damages of any kind derived from:

• The availability and technical continuity of the operation of the App/widget. However, MeetingDoctors will carry out all the necessary actions to restore its services in cases of technical failure.
• Interferences, omissions, interruptions, computer viruses, breakdowns, and/or disconnections in operation and functioning of this electronic system or the users' devices and computer equipment due to causes beyond the control of MeetingDoctors, which prevent or delay the provision of services or App navigation.
• Delays or restrictions in the use of the service caused by deficiencies or overloads of the Internet or other electronic systems
• Impossibility of providing the service or allowing access for reasons not attributable to MeetingDoctors, such as due to acts or omissions or users, third parties, or the involvement of force majeure.
• The access and use of the information and content obtained through the App or widget
• Any error or omission that may be in the contents or services.
• Any action taken by MeetingDoctors or the Healthcare Professionals based on inaccurate information provided by the User.

In particular, and without limitation, the User must not:

• Provide data to MeetingDoctors that is inaccurate, false, incomplete, and/or not up to date.
• Access the service provided by MeetingDoctors using the name, identification data, or password of another user or impersonate any other person or entity.
• Resell or provide the services to third parties using the information and benefits obtained through MeetingDoctors (this includes using the service to collect data from other users).
• Use the service to communicate any information or content that is contrary to law, such as information or content which is defamatory, aggressive, obscene, sexually explicit, offensive, violent or inciting violence, racist or xenophobic, or illegal in general.
• Violate the intellectual or industrial property rights of MeetingDoctors or third parties.
• Infringe upon any rights related to personal data or privacy of any natural or legal person or the reputation of any third party through the service provided by MeetingDoctors.
• Send or disseminate information, codes, or content that may reduce, harm, disturb or prevent the regular use of the service by any other user or that may damage or harm the equipment or property of MeetingDoctors or other users, including, without limitation, malicious applications, viruses, unsolicited messages (spam). MeetingDoctors reserves the right to delete messages sent by a user to ensure good quality use of its service.
• Send commercial communications or any other type of advertising not authorized by MeetingDoctors by any means (including, without limitation, by email, SMS, or any other means of communication) to third parties or any other user of the service provided by MeetingDoctors.

In any case, the User will be solely responsible for any damage or loss, direct or indirect, that could be caused to another person for the breach of these Conditions, as well as for the damages caused to MeetingDoctors for the incorrect use of their services and for providing data that is not true, accurate, complete, or current, and for any actions by the User that damage, disable, overload, deteriorate, or impede the normal operation of the App or widget.

User Code of Ethics:

All communication must be based on respect and politeness to benefit the progress of social and/or professional relationships and strengthen the trust of the individuals and groups involved.

MeetingDoctors declare as vitally important, and the User who accepts these terms and conditions confirms that they will adhere to the principles of mutual respect and politeness in the messages exchanged.

The entire communications must remain respectful at all times and consistent with the following values: Ethical and moral integrity; Respect; Equality; Non-discrimination based on sex, sexuality, origin, nationality, religion, or beliefs; Solidarity; Tolerance; Information; Veracity and Transparency; Honesty; Cordiality and Attention; Confidentiality.

The User will observe and respect all applicable laws, regulations, codes of conduct, practices, and customs at all times.

In particular, the User undertakes not to use inappropriate content in their communications that violate ethical, moral, or regulatory principles, commit or allow acts of impersonation or deception, or repeatedly abuse the service after receiving warnings from MeetingDoctors.

MeetingDoctors reserves the right to provisionally interrupt the service, or cancel it definitively, if the User, once previously warned, does not respect this code of ethics in communications with the Healthcare Professionals.

Intellectual and industrial property

Trade names, logos, brands, and all distinctive signs contained in this App or widget are protected by law. Any misuse of such elements by a person other than their legitimate owner may be prosecuted in accordance with applicable laws.

In accordance with applicable law, the reproduction, distribution, commercialization, copying, transformation, public communication, assignment, dissemination, or any other similar action that violates intellectual property rights over all content obtained or accessed by a user's use of the App or widget is prohibited.

Likewise, the modification or elimination of any content of the App or widget, as well as the use, copying, or distribution of the text or other content that composes the App/widget, is strictly prohibited.

The User can only use the contents of the App/ Widgegt for personal use.

Update, Modification, Elimination

MeetingDoctors reserve the right to update, modify or delete the contents of the App or widget, as well as these Conditions, and some or all of the services provided through the App/widget.

MeetingDoctors further reserve the right to temporarily or permanently limit or disallow access to the App/widget or any of its contents.

Security

All communications made through the App/widget are carried out using SSL (Secure Sockets Layer) protocol, signed with a certificate from an authorized certifying entity. MeetingDoctors undertakes the application, pseudonymization, and encryption techniques to keep and maintain the personal data that users provide confidentially, increasing its security and taking steps to prevent access by unauthorized third parties. MeetingDoctors strives to adopt all the necessary measures to protect user data and undertakes to improve its security practices in accordance with current laws and technological advances that may exist.

Cookies

Cookies are small text files that are used to store information about web browsers. They allow a website to store and receive identifiers and additional information about computers, telephones, and other devices. Other technologies are also used for similar purposes. For these Conditions, all the technologies referred to are called "cookies."

The cookies of the healthcare chat and video call service are proprietary to MeetingDoctors and are not shared with third parties. Cookies are used when registering as a user of the MeetingDoctors chat service. Cookies allow MeetingDoctors to understand the information received from the User and provide, protect and improve the healthcare service. For example, cookies enable personalizing content, measuring performance, and providing greater security.

MeetingDoctors uses cookies to verify the User and determine when they log into the platform to help them access the MeetingDoctors service and show them the appropriate experience and functions. For example, cookies keep the User's session open while browsing. Cookies also help us remember the User's browser so that they do not have to log in to MeetingDoctors repeatedly and can easily access the platform.

Data Protection

The User's personal information is stored in a database owned by MeetingDoctors, which employs all appropriate technical and organisational measures to protect the integrity and security of the personal data. The security measures adopted by MeetingDoctors are at least those required by applicable laws and provide a high-security level to users.

Only the Healthcare Professionals, designated employees of MeetingDoctors, and users will have access to the User's personal information to provide the healthcare service offered through the App or widget. MeetingDoctors will not disclose personal information to third parties, unless required by law.

MeetingDoctors also collects certain information (that does not contain personal information) related to the interactions carried out by users of the App. This information is used only for preparing statistical information about the App/widget.

In particular, the User is informed that by accepting these Conditions, they expressly consent to the collection, use, and disclosure of their personal information to Meeting Doctors and the Healthcare Professionals to provide the service to the users.

The User accepts that with the User's consent, the contact identification information may be used or disclosed for sending information and commercial offers to the users through the performance of merchandising and marketing by any means, including electronic, such as push messages, SMS, MMS, email;

In the case of the cessation of the service, user data will continue to be kept in accordance with applicable laws for as long as it is legally required.

The User may exercise, where appropriate, their rights under applicable privacy laws or make any inquiry, consideration, or claim about how their personal information is dealt with by sending an email to MeetingDoctors Data Privacy Officer, at the email address: dpo@meetingdoctors.com
